Acer Gadget Inc. ("AGT" or "We") provides you access to the AGT service through Acer Gadget XXX App, through APIs, and through third-parties (collectively "Service" or "APP"). A "Device" is any computer used to access our Service, including without limitation a desktop, laptop, mobile phone, tablet, or other consumer electronic devices.

We commit to respect and protect the privacy of our users. This Privacy Policy hereunder is to inform you of our online information practices, our practices concerning the collection, storage, processing, transfer and use of personal information, and the choices available regarding the collection and use of your personal information. This Privacy Policy governs your access of our Service, regardless of how you access it, and by using our Service you consent to the collection, transfer, processing, storage, disclosure and other uses described in this Privacy Policy.

What We Collect and How We Collect It

We collect various kinds of information to help us better serve uses to our APP:

• Internet Protocol (IP) Addresses. For each visitor accessing or using our Service or browsing our APP, our web server automatically recognizes and stores the visitor's IP address (the internet protocol address of the visitor's computer) to determine which areas of APP are being visited and how long each visitor spends there. This information helps us understand visitors' traffic patterns through our Service and APP so that we can enhance the overall usability of our APP. Your computer provides this information automatically each time you log on, unless you have activated blocking technology available in some browsers.
• Device Information. We may collect device-specific information, such as your hardware model, operating system version and unique device identifiers. We may also collect and store information (including personal information) locally on your device using mechanisms such as browser web storage (including HTML 5) and application data caches.
• Location Information. Similar to many current wearable devices, services, software, and apps, when you consent to and enable the relevant functions of the mobile application, we may obtain your location information through the GPS, Wi-Fi, or mobile network signals of your device. We will only request access to or collect your location information when you choose to use features that require geolocation data, such as "Outdoor Activity Recording," "Route Tracking," or other similar functions. You may disable location permissions at any time in your device's system settings. However, if you disable such permissions, certain features that rely on geolocation will no longer be available. We may use your device's location to record activity data, route parameters, environmental conditions (such as temperature), and other related information. In addition, to improve your user experience, we may use device information in various ways, such as analyzing device data and environmental factors to provide suitable recommendations, optimize training programs, and calculate calorie consumption.
• Cookies. Like many Apps today, we may employ a standard technology called cookies to collect information about how you use our APP in order to provide you with a better experience by measuring which areas of our APP are of the greatest interest to you or to remember you when you return to visit us. Most of browsers you are available to erase cookies from your computer's hard drive, block acceptance of cookies, or receive a warning before a cookie is stored. You can choose to set your browser to notify you when you receive a cookie, giving you the choice of rejecting or accepting the cookie.
• Personal Information. While we do not generally require that you provide us with individually identifiable information in order to visit, access or use our APP, at times we may ask you to provide us with personal information that is associated with individually identifiable information, such as your e-mail address, name, mailing address, telephone number, demographic information, or persistent identifier (such as user name and password). Providing us with personal information aforesaid allows you to use AGT's advanced services, include but not limit to, make purchases, register products, receive support, correspond with us, participate in online surveys, subscribe to mailing lists or newsletters, or register for special purchase discounts. We do not require you to provide sensitive personal information (such as information about your health, political or religious beliefs, criminal offences alleged or committed, or sexual orientation), and request you DO NOT provide us with such information. Nevertheless, any sensitive personal information you provide voluntarily to us will be used only in accordance with this Privacy Policy.

If the data which you provide contains third party's personal information, you acknowledge that such third party understand and recognize the rights under this Privacy Policy; and you shall guarantee that you have obtained the consent of such third party and authorize us to use the personal information of such third party in accordance with this Privacy Policy.

In the event that the personal information which you provide to us is insufficient to confirm the authenticity of your identity, or that it is the result of any false identity or identity theft or is unreal, we are entitled to terminate our Service to you. We apologize for any inconvenience caused as a result thereof, if any.

What We Do with Personal Information

The personal information you provide may be used to support the customer relationship between you and AGT. We want to use the personal information you provide to tailor your experience at our APP and with us generally. We do not collect or use the personal information which you submit for any unrelated purposes, unless otherwise we are obligated or permitted by local laws to do so by informing you in advance.

We will send you information about our various service/product upgrades, special offers and other new products and services from AGT that we feel may be of interest to you, unless otherwise you specifically instruct us not to do so. Only AGT (or agents working on behalf of AGT) will send you such information directly. If you do not want to receive such information, you may opt-out of receiving such information at any time by contacting AGT; see the opt-out section below.

We may also use your information to comply with laws or to defend ourselves in claims under such laws, or when necessary to exercise AGT's business interests and legitimate needs, in which case special measure is taken to safeguard your rights and to ensure any use of your personal information is fair, lawful and proportionate.

Unless otherwise prohibited by laws or regulation, we may provide, assign and/or transfer your information to our affiliate to collect, store, process and utilize. Any of our affiliate receives your information shall be bound by this Privacy Policy.

AGT will not share your personal information with any third party for its use in marketing or solicitation without your consent. Your information may be shared with AGT's agents or contractors for the purpose of providing Services, processing transactions or performing statistical analysis. For example, if we need to ship something to you, we must share your name and address with a shipping company. We only provide necessary information to our agents or contractors to complete the requested services or transaction.

Your information may also be disclosed to third parties where we are legally required or entitled to do so, for example, in response to a request from a government or regulatory authority or in connection with potential legal proceedings. AGT is not responsible for the actions of any government or regulatory authority with respect to your information or data. If we merge with another business (or enter into discussions concerning the same) we may share your information with such a business and its advisers; however, if we do so, we will ensure steps are taken so that your rights in relation to your information continue to be protected hereunder.

Children's Guidelines

AGT will NOT collect online contact information from children or juveniles (as defined by local requirements), and if we learn that we have personal information about a child or juveniles, we will delete it from our systems. AGT encourages parents or guardians (including other legal representatives) to spend time online with their children and to participate in their online activities. Children or juveniles are eligible to use our online sales transactions services ONLY with a parent's or guardian's consent to and payment for the transaction, or to the extent permitted by applicable law. If you are a child or a juvenile, you are required to get the permission of your parents or guardians in order to complete certain transactions on this APP.

Users from Taiwan

If you are a user from Taiwan, we hereby draw your attention to the following in accordance with the relevant law and regulations of Taiwan:

• We will maintain and, when necessary, use your personal data from the time when you provide it to us through any means until you request us to delete it. The geographical scope of our use of your personal data is limited to Taiwan, the jurisdiction in which you locate and the place where AGT's subsidiary operates only.
• You may exercise the following rights with respect to your personal data pursuant to the Personal Data Protection Law:
  • any inquiry and request for a review of the personal information (fees apply depending on each individual case);
  • any request to make duplications of the personal information (fees apply depending on each individual case);
  • any request to supplement or correct the personal information;
  • any request to discontinue collection, processing or use of personal information; and
  • any request to delete the personal information.
  • The servers providing online services process and store an enormous amount of information each day and keep a record of the processing performed. These computer records are called "log files". After the information in the log files has been processed, it is stored and blocked from further access. Until the information is stored, your account information may remain in our active server log files.
• If the data which you provide contains the personal data of any third party, you confirm that such third party has knowledge of the rights under this Privacy Policy, and guarantee that you have obtained the consent of such third party and authorize us to use the personal data of such third party in accordance with this Privacy Policy.
• If you decline to provide, or request us to cease using, processing and using or request us to delete, your personal data, we will be unable to contact you for the relevant matters regarding our Service, keep a record for future inquiry, provide you with the latest information of the our Service or conduct customer review, and we may not continue our Service and shall not be responsible for any losses arising therefrom.

If you are visiting our APP from outside of the United States or otherwise contacting us from outside of the United States, please be aware that your personal information may be transferred to, stored or processed in, the United States, where many of our servers are located. The data protection and other laws of the United States and other countries might not be as comprehensive as those in your country, but please be assured that we take steps to protect your privacy. These rights include the right to: confirmation of the fact of processing; access data; correct incorrect or outdated data; anonymization, blocking or elimination of unnecessary or excess data; portability of data to other service providers; eliminate data; information about to whom personal data was provided; information on consequences of not providing consent; revoke consent; and petition the public authority, if you believe that AGT is not handling your personal data correctly. • Your personal data will not be stored for longer than is necessary in relation to the purposes for which we process them. Only where we are legally obliged to, or where this is necessary for defending our interests in the context of judicial proceedings (for example in case of a dispute), we will store the personal data for longer periods. For example, due to legal administration, retention or tax obligations. Personal data that we process in the context of a purchase made by you, will be kept throughout the life cycle of agreements we conclude with you and, after the termination thereof, in accordance with the statutory limitation periods.
• The legal grounds used for our processing activities are:

• Transfer of your personal data
  Where your personal information is transferred to an AGT's affiliated company or agent outside of the EEA, or to a third party outside the EEA, appropriate steps are put in place to provide adequate protection for the data, in accordance with the General Data Protection Regulation. Where applicable, data transfers may take place on the respective decision of the European Commission on the adequate protection of personal data and based on other (bilateral) agreements recognized by the European Union. Use and Disclosure of Anonymous Aggregated Information

AGT may also collect, aggregate and maintain anonymous information about our users and online visitors to our APP, such as visitors' hobbies, interests, purchasing habits and the like. This data can then be used to tailor our content and services to deliver a better experience for visitors. In addition, AGT may also share such aggregate information about our visitors with advertisers, business partners, sponsors and other third parties, for example, to inform them of the percentage of male/female visitors or the percentage of visitors within a particular age range.

Security Measures

We protect the personal information which you share with us. In AGT, only limited employee and our authorized third party may access to your personal on a need to know basis for accomplish their work. It is our policy to maintain the integrity of any personal information in our possession. To prevent security breaches, AGT uses several security techniques, such as SET or industry-standard Secure Socket Layer (SSL) encryption for transmission of credit card information or wherever personal information is required, to protect any personal information from unauthorized access by users; however, we cannot assure or indemnify the security of internet.

AGT does not share any personal information with other websites and is not responsible for any information, content or policies of other websites that linked to/from our APP. AGT does not warrant or support any information, content or policies given on any website that is not controlled by AGT.

How to Opt-Out of Our Use of Your Personal Information
